On February 1, 2024, the Labor Directorate issued Ruling 81 / 02, which provides information regarding the content and entry into force of Law No. 21.561, which amends the Labor Code to reduce working hours, published in the Official Gazette on April 26, 2023. In this document, we summarize Ruling 81 / 02.-
Let’s recall that Law No. 21.561 modifies the Labor Code in the following areas:
1) Exclusion from working hours limitation (Article 22 of the Labor Code).
2) Two-hour window for mothers and fathers of children up to 12 years old and persons in their care, within which they can advance or delay the start of their workday by up to one hour (Article 27 of the Labor Code).
3) Compensation for overtime by additional vacation days (Adds paragraph 4 to Article 32 of the Labor Code).
4) Attendance records through electronic systems (Substitution of Article 33 of the Labor Code).
5) Distribution of Sunday rest days for workers in casinos, hotels, pubs, nightclubs, restaurants, clubs, bars, and similar establishments, and tourism operators (Inserts new paragraph 5 to Article 38 of the Labor Code).
6) Exclusion from the weekly working hours limitation in the case of telework (Paragraph 4 Article 152 quáter J of the Labor Code).
